Glinkin Holistic Sport Center L.L.C-FZ notifies that it is the operator (controller) of personal data and will process the provided personal data in accordance with Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data of the United Arab Emirates (“PDPL”) and, where applicable, Regulation (EU) 2016/679 (“GDPR”), together with the terms of the User Agreement, the Privacy Policy of Glinkin Holistic Sport Center, and this Consent.

Consent to the processing of personal data

I hereby give my consent to the processing of my personal data, including: collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (provision, access), including cross-border transfer, depersonalization, blocking, removal, and destruction, of the following personal data (“Personal Data”):

• first name;
• phone number;
• e-mail address;
• device information, log data and product usage data;
• cookies.

to the operator of Personal Data (“Operator”) — Glinkin Holistic Sport Center L.L.C-FZ (License Number: 2533497.01; registered address: Meydan Grandstand, 6th floor, Meydan Road, Nad Al Sheba, Dubai, U.A.E.).

I. Processing necessary for the performance of the contract and legal obligations (no consent required)

I understand that the Operator will process my Personal Data for the following purposes, which are necessary for the conclusion and performance of the User Agreement, provision of the Services, compliance with legal obligations, and protection of legal rights, and therefore do not require my separate consent:

• conclusion and execution of the User Agreement;
• providing access to the Site and its functionality;
• communication with me regarding my requests and service updates;
• compliance with court orders, lawful requests of public authorities, and accounting/legal requirements;
• prosecution and defense in legal proceedings.

I acknowledge that this processing is based on the legal ground of contractual necessity and is mandatory for the use of the Services.

II. Consent for additional processing (optional)

I hereby give my separate, freely given, and informed consent to the processing of my Personal Data for the following purposes, which are not necessary for the provision of the core Services:

• sending me promotional materials and marketing communications (I may withdraw this consent at any time);
• collection and analysis of statistical information to improve the Site and personalize my user experience.

I acknowledge that my refusal to give consent under Section II will not affect my ability to purchase and use the core Services under Section I.

I acknowledge that I have the right to withdraw this consent at any time. Withdrawal shall not affect the lawfulness of processing based on consent before its withdrawal. I also acknowledge that processing of my Personal Data necessary for the performance of the User Agreement does not require my separate consent and is based on the legal ground of contractual necessity.

I agree and authorize the Operator to process my Personal Data using non-automated methods of processing, as well as automated database management systems and other software used by the Operator.

I agree that, where necessary for the implementation of the Purposes of processing Personal Data, the Operator has the right to entrust the processing, including the cross-border transfer, of my Personal Data to third parties, subject to compliance with the requirements of applicable law on the confidentiality and security of Personal Data during processing. When transferring such data, the Operator will inform the recipients that the data is confidential and may be used only for the purposes for which it was communicated, and will require such recipients to comply with this rule.

A request to exclude, correct, or add to incorrect or incomplete Personal Data may be submitted as a written request to the Operator at [email protected].

This Consent to the processing of Personal Data is valid from the date of its signing until the Purposes are achieved, and in any event for the duration of the contractual relationship between the Operator and me and for such further period as is necessary to comply with applicable legal, accounting, or regulatory obligations.

I understand that I may withdraw my consent at any time by submitting a written statement to the Operator at [email protected]. Upon withdrawal, the Operator will cease processing my Personal Data for purposes based solely on consent, unless such processing is required or permitted by applicable law.

Any request to cease storage of my Personal Data will be processed within a reasonable time, and the Operator will inform me if law requires any retention.
